(Gateway Pundit) – Thank you, Maxine Waters. A man named Frank posted a video to his Twitter account Saturday night claiming he and his family were denied service at Ruby Tuesday in Roanoke Rapids, North Carolina because he was wearing a “Trump – Make America Great Again” t-shirt.

Frank said there were plenty of empty tables in the restaurant and people who walked into Ruby Tuesday after him and his family were seated right away.

He decided to vent on social media.

“Cannot believe our family was denied service at Ruby Tuesday in Roanoke Rapids North Carolina because I am wearing a Trump shirt. Very sad!” Frank said in a tweet.

I’m not a lawyer. And I don’t play one on TV. But you can file a civil rights lawsuit for a “protected class” reason only (race, national origin etc.). Political affiliation is not one of the protected classes.

And it’s not a free-speech issue. You can’t just say whatever you want on someone else’s property.

But as you said, if the situation ere reversed the ACLU would sue. The lawsuit would fail. But they would try anyway. And maybe Antifa would show up, and break a few windows.

I was at a bar during the election season, guy and his wife walk in, he has a deplorable T-shirt on. He ask me if the table next to us was taken. I said “It’s all your’s this is the deplorable section”.

I am not a lawyer either.
But this isn’t someone else’s property. Its a business open to the public.
Its a legal subject which should be pursued in the courts.

That’s what I would say. However I’ve not found a definition of creed that expands it beyond religion. If it only covers religion then it’s redundant since these antidiscrimination laws almost always list religion as well.

I have never been to a Ruby Tuesday before. The one down the road from me closed recently, I noticed.

As a family, it's just not economically smart to eat at these types of places anymore (Chillis, Applebees, Red Robin) by the time we leave with tax and tip it is easily $75-95 for subpar food.

Respect the wishers of these lowlifes - leave.

If you stay they'll spit in your food or poison your children.

Democrats are thugs backing thugs... these are the same tactics they used in the Jim Crow South... and they have others.

Want to get even? Write reviews... trash them politically. Hate them and their 'establishment' forever. Tell your friends and neighbors. Turn them into the health department.

But don't let them poison your family. NOT worth it.

So who can businesses refuse service to?

These signs also don’t allow business owners to refuse service based on arbitrary reasons outside of the protected classes (though pointing out signs to cries of “No fair!” might avoid any further action on the part of spurned patrons). Instead, reasons must be legitimate enough to hold up in court. In general, refusal of service is justified in cases where a customer’s presence interferes with the safety and well-being of other patrons and the establishment itself. The most basic examples of this include patrons who are unreasonably rowdy, patrons lacking adequate hygiene, and those accompanied by large groups of non-customers.

What are they going sue for? Bad service or no service?

Not seating you in a restaurant is not a suable offense. It's the owner's prerogative.

Besides, who would want to get embroiled in a lawsuit where the lawyers would get most of the money and you would have your life turned upside down for several years?

The solution in a free America is to just chose not to patronize them anymore and go somewhere else to eat.

How hard is that?

North Carolina is FULL of Northeast transplants.

And like all places that the NE moves to, it simply becomes a liberal paradise.

This isn’t because of lefties moving from the NE. This is because of so-called NE conservatives. They are the ones who are moving there. They bring their “but conservativism” with them and bend things to the left.

Happened about 15 years ago and NC is about 10 years into the change. I’m from the NE and I can smell that sh!t from 1000 miles away.

Arkansas is particularly affected by this from california. They don’t see it - but I do and I’m raising the alarm. Texas is bending left as well and those from TX refuse to see it.

Idaho is fighting it and I have to figure out how.
