When you are approached, is there a difference? I say not. And they can be queried by the police, or a judge. Make them think twice about their behavior. If can be construed as a threat, arrest and throw them in jail.

There are several terms at play, assault, battery, intimidation, etc. Where's the line for each. Anyway, some is also a matter of intent. If they are doing it to scare or chase away the person, that is problem. If they are simply stating opinion, no so much so. How was it received?
