It's an utterly moot point because the National Guards are not subject to Posse Comitatus, so he just as easily have "requested" that the governors of the border states send their guard units, and also request that their non-border neighbor states also send theirs to assist.

Trump has 'em by the short 'n curlies either way.

But as a commentator elsewhere pointed out, Trump could send sailors from the Navy and the Coast Guard to the border. Since they are technically not mentioned at all in the Posse Comitatus Act, they would CLEARLY be exempt. This as JW Gordon pointed out would drive the Left crazy because the law would not apply.

IMO, if we don’t use the military to stop them at the border, the population will use their private weapons to stop them as they scatter.

National Guard is different. They belong to the governor.

Only until the President declares he wants them. The National Guard is a federally-funded reserve component of the US Army. The President can take control whenever he wants

In return, the federal government gained greater control over the National Guard. The President of the United States was empowered to call up the National Guard for up to nine months to repel invasion, suppress rebellion, or enforce federal laws. Guardsmen had to answer a presidential call or face court-martial. States had to organize, equip, and train their units in accordance with the policies and procedures of the regular Army. If Guard units failed to meet Army standards, they would lose federal recognition and federal funding.[21]

Actually, the Posse Comitas law delayed the Federal government from fully aiding Louisiana until Governor Blanco finally relented and authorized it.

The law was partially modified after that. A similar event had happened with Hurricane Andrew and Governor (Chiles?) - Democrats delaying disaster aid to their own state to make the Republican President look bad.
