FL Judge Orders Camps to Tone Down the Recount Rhetoric

Florida county officials are expected to submit their final vote tallies by 3 p.m. Thursday, so we can finally declare winners in both the Senate and gubernatorial races. State law requires that races with less than a .05 percent margin get a recount. Republicans, however, who are currently in the lead in both races, see no need for the recounts.

Florida Gov. Rick Scott accused Broward Supervisor of Elections Brenda Snipes and Palm Beach Supervisor of Elections Susan Bucher of “trying to steal the election.” There's certainly reason to believe Snipes is operating under an ideological motive. Her office unlawfully destroyed ballots in the 2016 Democratic primary election with Debbie Wasserman Schultz. Scott is one of many Floridians to demand Snipes be removed from office.

Broward Circuit Judge Tuter is well aware of the stakes of these elections, but he ordered both sides to be careful what they say about their opponents because the country is watching.

“We need to be careful what we say — these words mean things these days,” Tuter said. “Ramp down the rhetoric, if someone in this lawsuit or someone in this county has evidence of voter fraud or irregularities at the supervisor’s office, they should report it to a local law enforcement officer.”

Of course, Trump has only begun to ramp up the rhetoric on his Twitter. 

The Florida Election should be called in favor of Rick Scott and Ron DeSantis in that large numbers of new ballots showed up out of nowhere, and many ballots are missing or forged. POTUS is talking about the thousands of votes that were discovered last week. "More than 80,000 votes were spoken into existence," Republicans angrily charged

Tuter did not grant all of Gov. Scott's requests, which included impounding voting machines that were not being used, but he did concede to add three Broward Sheriff's deputies to oversee the recount.

As of Monday afternoon, Broward County had still not started counting.

The same Department that agreed not to issue citations to youthful offenders less the plethora of them embarrass the County School Supervisors and diaqualify the schools for Federal funding? That instead asked that the offenders enter programs to "redirect" their bent to scoff at the common laws and break them into "safer" channels?

Doubtless this judge will see that the deputy-overseen inspectors will massively "redirect" ballots so that the Demmicratic challenger candidates do not "steal" the election, merely outfox the legitimate system and suborn it?

I guess that Judge Tuter never heard of the 1st Amendment.

So let me get this straight. In Florida, judges can assume the role of local police dispatchers and shift schedulers. Isn't just ducky how judges find ever more all-purpose reasons to expand their power and reach.

Broward’s slow handling of the elections process has drawn criticism and protests from mostly conservatives. Among them are people like Gov. Rick Scott and President Trump who have claimed without evidence that the county is a hotbed for election fraud. The Florida Department of Law Enforcement and the Florida Secretary of State’s Office say they have not found any evidence that voter fraud is happening.

Heavily Democratic Broward County’s votes trickled in slowly after most other counties had already posted preliminary results, which had the effect of narrowing leads held by Republicans for Governor and US Senate races days after the election. In the case of the Agriculture Commissioner race, the slow-moving results saw Democrat Nikki Fried suddenly overcome Republican Matthew Caldwell, leading Fried to declare victory.

Gov. Scott has sued elections officials in Broward and Palm Beach Counties for public records violations. Courts have so far ruled in his favor. (He has not argued about “fraud” in his lawsuits, only while giving stump speeches.)

The Palm Beach Supervisor of Elections office started sorting through ballots in preparation for a recount last Thursday, like Miami-Dade County. But Susan Bucher, the county’s elected Supervisor of Elections, has been publicly skeptical that her staff will be able to complete the recount deadline for all races.

The ballot counting equipment used in Palm Beach County has been in use for over a decade, and the state’s recount deadline is “irresponsible,” she said.

“Our equipment isn’t designed to meet the deadline and we’ve been complaining to the state for almost 10 years and they’ve never extended the deadline,” Bucher told the Palm Beach Post. “We’ll give it our best shot effort, but what we need to do is machine-recount all of our ballots.”

Miami-Dade Commissioner Jose “Pepe” Diaz looks at the situation engulfing Broward and Palm Beach Counties, and expressed relief that Miami-Dade is not the center of controversy.

“I attribute it to professionalism, I attribute it to a great elections director that we have, and anticipating everything that can happen,” Diaz told WLRN. “We’re the largest county and we have the largest amount of votes, so everything has to be flawless.”

Why can’t Trump order federal agents down there (not sure if they can be any more trustworthy than the Coward PD that are overseeing the voter fraud going on) to keep things on the up and up?

I think what Trump should do is, using Mueller as a precedent that meddling with elections takes us to Defcon 1, appoint a special prosecutor with the same sweeping mandate and unlimited resources that Mueller has to investigate voter fraud.
