It’s a valid legal argument, but the bigger question is whether the Federal Vacancies Act is constitutional as it applies to “principal officers” of the Executive Branch under the Appointments Clause of the U.S. Constitution.

The exact wording of section a3 of the Federal Vacancies Reform Act of 1998, (5 U.S.C. § 3345) is:

"the President (and only the President) may direct an officer or employee of such Executive agency to perform the functions and duties of the vacant office temporarily in an acting capacity, subject to the time limitations of section 3346, if— (A)during the 365-day period preceding the date of death, resignation, or beginning of inability to serve of the applicable officer, the officer or employee served in a position in such agency for not less than 90 days"

I wonder which of those words the naysayers don't understand.

The operative term here is “Acting”. SOMEBODY has to be filling the slot, and it may or may not be appropriate to place this before the current sitting Senate, but rather to wait until the new Senate members are sworn in.

Which won’t be long now.

Saw this on The Liberty Daily today:

NOW A WITNESS CHARGES MUELLER'S TEAM WITH CONFLICT OF INTEREST: Lawyer represented Hillary Clinton but grilling people for special counsel

Farther down in the story it mentions the Dems wanting Whitaker to recuse himself because he worked for Sam Clovis in 2014, and Clovis went on to briefly work for the Trump Campaign and testified in the Mueller investigation in 2017. But of course, no Dems are condemning Jeannie Rhee's working for the Special Counsel.

Al the liberal aholes and so-called law professors are full of crap and they know it. They are just blowing smoke up the liberals/progressives collective butts as a cover for their being stupid, ignorant of the law, and biased, and the leftist media falls for it like a two-bit whore going after a $20 bill on the ground.

Any and all lawsuits on this issue will be either thrown out or ruled as irrelevant, wrong law application, etc.

No wonder we have so many Avenatti’s and now Ted Olsen, etc.

Our law schools have too many reds and pinkos teaching there and they are turning out little Marxist attorneys who know nothing about “real law”, only ‘social justice’ law.
