Had to be deliberate. Obama’s attempt to eliminate private property.
Maybe they didn’t. Both parties may appeal a decision they don’t like.
Much ignored is the fact that Obama had no fewer than 13 unanimous SCOTUS rulings against him in just the first 4 years

JUDGES/PLAINTIFFS who were responsible for wasting SCOTUS time should be heavily sanctioned and fined.
9-0 means this was a nuisance suit.
Or perhaps Roberts told Ginsberg and company: "We can have a 9-0 decision on a narrow basis, or we can have a 5-4 decision that designating land as endangered species habitat is a 'taking' which requires the government to pay the owner the full fair market value of the affected land".
