SAN FRANCISCO — A divided U.S. appeals court late Friday refused to immediately allow the Trump administration to enforce a ban on asylum for any immigrants who illegally cross the U.S.-Mexico border.
The ban is inconsistent with an existing U.S. law and an attempted end-run around Congress, a panel of the 9th U.S. Circuit Court of Appeals said in a 2-1 decision.
"Just as we may not, as we are often reminded, 'legislate from the bench,' neither may the Executive legislate from the Oval Office," 9th Circuit Judge Jay Bybee, a nominee of Republican President George W. Bush, wrote for the majority.

Is this the same Ninth Circus saying that Trump can’t write his own law to restrict asylum, that said it was OK for Obama to write law for DACA?
Brybee is also the same so called judge that had an angry outburst about Trump’s so called judge comment.
The American system is rotten to the core. This is not how it was to work and a total perversion of its design. Our country is actually dying by the Constitution as it is being used against itself and America.

I’ve been saying for years the freedom guaranteed to “all men” will be used against us.
In times of invasion it is the job of the president to protect the country. He does not need congress in this instance.
But they legislate from the bench all the time, anyway, don’t they? They’re mocking the President. Their hypocrisy is rank!
I get the impression that most the 9th Circus judges believe that the President of the United States has no power whatsoever.
The courts are the last refuge of the scoundrels and a reminder that elections seem to only go so far even if we elect Donald J. Trump as our President.
They only believe that about Republican presidents.
We can slow walk the asylum applications
