Supreme Court sides with Planned Parenthood in funding fight [Roberts, Kavanuagh join libs]

The Supreme Court Monday rebuffed efforts by states to block funding to Planned Parenthood.

It left in place two lower court opinions that said that states violate federal law when they terminate Medicaid contracts with Planned Parenthood affiliates who offer preventive care for low income women.

It would have taken four justices to agree to hear the issue, and only three conservative justices -- Clarence Thomas, Samuel Alito and Neil Gorsuch -- voted to hear the case.

Chief Justice John Roberts and Justice Brett Kavanaugh appeared to side with the court's liberals in not taking up the case -- showing an effort to avoid high-profile abortion-related issues for now.

Roberts and Kavanaugh "likely have serious objections," said Steve Vladeck, CNN Supreme Court analyst and professor at the University of Texas School of Law. "But such votes seem to be a signal that they would rather avoid contentious, high-profile disputes for now, at least where possible."

The case concerned whether states can block Medicaid funds from Planned Parenthood affiliates that provide such women with annual health screens, contraceptive coverage and cancer screening.

SCOTUS ducked this issue in a way that will disappoint both sides. There are now conflicting appellate court decisions regarding the ability of states to block PP or any other organization from receiving Medicare funds. This is exactly the situation that calls for resolution by the high court.

It never ceases to amaze me that for all the political talk that goes on within this forum how BADLY some of you understand the game that is politics.

More to the point, this case wasn’t even heard much less tried. This failed a Certiori grant, meaning it can be brought again.

Ruling against Abortion is going to happen eventually and we have to hope it’s basis is on such strong ground legally and constitutionally that it won’t be over-ruled easily or else we are just wasting time.

George W. Bush fighting for Kavanaugh was a BIG clue that Kavanaugh was GOPe. I have no idea who convinced President Trump to nominate him rather then a tried and true conservative.

There’s not a federal obligation that the feds send such money at all.

No more than there is a federal authority to take it in the first place.

A potential justice’s religious affiliation is part of the picture, but it doesn’t tell the whole story and may even be misleading.

The task of a justice is to interpret the Constitution and other laws. We often say that justices shouldn’t legislate from the bench. They shouldn’t bend the law. They shouldn’t declare an act of the legislature unconstitutional just because they don’t agree with it. They should try to find out what the text meant when it was adopted.

A justice’s religious faith may influence how he will decide abortion and religious freedom cases. But as far as abortion is concerned, a pro-life justice who is an originalist won’t say that states must ban abortions.

In many cases religious values offer no immediate answer. What is the Baptist view of the Second Ammendment? What is the Presbyterian view of the Fourth Ammendment?

What about Harriet Miers? She gave that infamous speech, full of progressive views, after she supposedly became born-again.

This case has nothing to do with abortion. The case is determining whether or not Planned Parenthood has immunity from fraudulent billing, ignoring clinical as well as sanitation regulations/laws, and is allowed to operate a black market selling baby parts.

Apparently Roberts and Kavanaugh believe States can terminate contracts of unqualified providers unless they are called Planned Parenthood (Providers failing to live up to standards were terminated before). For now at least, there is another case waiting for cert. Right now I will give Roberts and Kav. the benefit of doubt because they may view the other case pending as more merit.
