Pence Casts Tie-breaking Vote to Confirm Federal Judge

Vice President Mike Pence had to break a tie in the Senate on Tuesday to confirm Jonathan Kobes as a judge on the 8th Circuit Court of Appeals. 

The 50-50 tie came thanks to Sen. Jeff Flake, who joined every Democrat in voting against the nomination. The retiring Arizona senator has vowed to block all judicial picks until the Senate votes on legislation that would protect special counsel Robert Mueller from being fired.

Kobes is the first judge in U.S. history to be confirmed by the Senate with a tie-breaking vote from the vice president, according to CBS News.

The judge was considered to be somewhat controversial after the American Bar Association rated Kobes “not qualified” for the bench, arguing that he has "neither the requisite experience nor evidence of his ability to fulfill the scholarly writing required of a United States Circuit Court Judge.”

The ABA said Kobes, 44, had not submitted enough writing samples to prove he had the professional caliber for the appointment. Most of his writing samples were from his early days as a lawyer or about "relatively simple criminal law matters," and none were "reflective of complex legal analysis," the ABA said. 

"Mr. Kobes is a very accomplished, competent, and capable person, but his career path has not resulted in sufficient evidence of a developed ability to do the written work of a United States Circuit Court Judge," the association said. (CBS News)

Kobes, a Harvard Law School graduate, is the fourth Trump judicial nominee to be confirmed that the ABA rated as “not qualified.”

Yes, this of course only concerns injunctions which give a district judge imperial national power. It is an anomaly in court powers as when a constitutional issue is decided at an appellate level, it is binding in that appellate circuit. If contested in another circuit it is up to the SC to decide (unless it is a 2A issue of course than it can be reappealed until the dems get what they want!)

Jeff Flake is a proven and well-known pedophile who is being blackmailed by Democrats. There’s reams of evidence of his love of 8 year old boys. No older, those ones are too aged for his tastes.

Well, Kavanaugh and Roberts aren’t bright, shining stars for us conservatives. They weren’t approved under Rat presidents.

So how long will it take to confirm all these judges that Flake has stopped in this session?

Do they have to be renominated?

Go through the committee again?

And they still have the 30 hours of debate each on the Senate floor.

It could be April before we catch up.

I’m just glad there will be 53 Republicans.

The terror on Flake’s face hints that the skeletons in his closet involve the worst possible moral offenses, while the public record points to Flake’s role brokering Zimbabwean uranium to Iran. Maybe both are right. Time will tell.

there are currently about 20+ pending confirmations on the district level and none in the circuit level due to flake being a member of the judiciary committee of 11-10 republicans and he has refused to vote them out of committee. once the next session starts, mcconnell will start putting the district judges up for vote and then grassley should have the ability to get these guys out of committee onto the floor.

if nothing else, I imagine mcconnell will be pretty ruthless in getting judges confirmed this next session.

I don’t know if it is true or not, of course, but there were rumblings that the reason Pence took such dramatic action to push for Flynn’s firing (which Trump of course almost immediately regretted) was because of Flynn’s plans to go after pedo issues in the gov—and that Pence’s good friend Flake would be caught up in that.
