BREAKING NEWS: Texas Judge has struck down Affordable Care Act, declared unconstituional

U.S. District Judge Reed O’Connor agreed with 19 States to declare the Affordable Care Act, (aka Obamacare) Unconstitutional because Congress revoked the tax penalty last year.

I think that the logic of Roberts’ prior opinion upholding Obamacare will more or less require him and the Court to strike it down. This will prove extremely awkward for the Democrats because they will then have to negotiate a compromise replacement plan with Trump and the GOP in Congress, but it is probably the best outcome for Roberts and the Supreme Court in that both political parties will have tacitly accepted the reasoning of Roberts’ prior opinion. Historically, that is how many controversial Supreme Court rulings become settled law.

Yes, but only since it was a tax. If it is not a tax then it must be voluntary.

Can’t find a list of the 19 states.

Alabama, Arizona, Arkansas, Florida, Georgia, Indiana, Kansas, Louisiana, Mississippi, Nebraska, North Dakota, South Carolina, South Dakota, Tennessee, Texas, Utah, West Virginia, Wisconsin, and my own state of Missouri.

The decision will be appealed and wind up before the Supreme Court. Nothing is going away in two weeks.

Because Obamacare was their crowning achievement after a century of “struggle”. And Republicans are unable to act on anything, in either direction.

Democrats cannot count on Republicans to fix what will become a completely collapsed healthcare delivery system. Republicans are always content to do nothing.

But Trump has the ability to at least make Republicans vote. And he wants that wall. And Dims want an Obamacare fix. And Republicans just want to be left alone.

Ergo, the natural makings of a deal.

I've been wondering (and complaining) for years that only leftist kook judges throw their weight around, issuing rulings that violate not only the will of the people, but common sense.

It would be great if this ruling is the first of many like it.
