The SC should’ve reached this conclusion in the first place. ACA was not a tax until Roberts re-wrote the Act to find the penalty was a tax. Penalty repealed, no tax. This ruling is a no-brainer and long overdue.

So, what next? Americans were facing deadline this weekend to sign up for plans for January 1. Now, do we sign up? What are our options? There do not appear to be any non-OCA choices. Will companies, can they, offer plans for January 1? Can they do so with all the regulatory red-tape? Bet this becomes topic 1 this weekend. Maybe an appeals court or Supreme Court will stay this until ‘what next’ is figured out? Surely folks are ready for this day?!

BLAST TO THE PAST!!!

February 2011

Larry O’Donnell blames Democrats for rushing the ObamaCare bill to a vote and forgetting to insert the severability clause, but Jonathan Turley isn’t buying the post-Florida verdict spin from Capitol Hill. He suggests that Democrats deliberately left out the severability clause as a triple-dog dare to judges. Take out the mandate, the strategy goes, and lose all of the goodies in the rest of the bill! Unfortunately for Democrats, they lost this particular round of “chicken.”

Lack Of Severability In ObamaCare A “Colossal Mistake”

Y'all remember WHY the Democrass did not correct the mistake?

Senator Ted Kennedy passed away! Scott Brown takes his place and the Democrats can not sent the bill back to the Senate for another vote!!

Congress did NOT repeal the “tax,” they reduced it to zero.

Roberts will argue that any future congress can raise the rate above zero so therefore the tax is still in effect.

Obamacare will remain the “law” of the land. Count on it.

Lovin it!

Nancy and the dims thought they were going to impeach VSGPOTUS and rummage through his taxes.

Now, they have to find a replacement for 0bama care.
Now, they have to fund the Government.
Now, they have to stop the CR’s and present a budget. They never passed a budget since the Bush Presidency.

Kinda happy the GOP is not driving the Congress to fix all of 0bama’s crap

CJ Roberts catches a lot of criticism from the Freep crowd, but I can’t buy the theories that he’s a closet fluffer or that he’s being blackmailed.

His basic theory seems to be a few things: One, if it’s a state issue, he’s going to throw it back to the states. Two, if it’s a congress issue, he’s going to throw it back to Congress (hence his ruling that OCare is a tax that Congress will have to address). Three, if there’s precedent, he’s going to see if precedent takes precedence in a case. Four, if a case comes to the doorstep of SCOTUS for perusal, he determines whether it’s got legs or not.

Has he actively legislated new law or swung to the left? Not really. And his rulings tend to be narrow, not sweeping, allowing for future hearings on cases in order to create clarity.

This was the lieral fascist Obama attempt to socialize 30% of the US economy.

It failed. Thanks be to G_d.

We still are a Free Republic, but the fight is not over. We have the deep state DOJ and FBI to destroy.
