Not unless he asks the judge to throw it out and he won’t. Because if it is thrown out then he will face prosecution for real crimes that have nothing to do with Trump and so will his son.

Interesting theory, but there's one angle to it that doesn't make sense.

Sullivan only asked for the 302 form (and other information that likely contains evidence of malfeasance among Mueller's team) because Flynn's lawyers referenced these documents in the sentencing memo they submitted last week. If Flynn's legal strategy is to just slink away and lick his wounds to avoid other legal trouble, then why even go to these lengths to expose prosecutorial misconduct after a plea deal where the prosecutor is already recommending hardly any punishment?

I think something big may be going on behind the scenes here. I've said this since Flynn and Manafort were indicted last year.

WHAT real crimes, Brilliant? There are none. Are you referring to the crime of a US citizen discussing foreign policy with a foreign government under which no one has ever been indicted much less convicted in the 219 years it has been on the books and which most constitutional scholars state is likely unconstitutional. Perhaps it was doing his job in reaching out to foreign nations as the incoming national security advisor? Maybe it was his advisory position for the Turkish government, which involved NO contact with any US government elected official, or regulatory agency, but which the office of the special counsel claims an op-Ed collumn written by Flynn positive to Turkey was intended to somehow sway "government" opinion necessitated his registration as a foreign agent. If so, any company or individual which accepts such a advice contract with any foreign government, including Hillary and Bill Clinton, John Podesta, Al Gore, and a host of other politicians, etc., would also be required to so register. It is a contrived charge which has been stretched completely out of all recognition to force Flynn into bankruptcy defending a flurry of such bogus charges.
