The Supreme Court held long ago in Brady v. Maryland that the Constitution requires the prosecution, which holds all the cards in a criminal case, to give the defense all evidence favorable to the defendant, whether it impeaches a witness, mitigates punishment or shows his innocence. Indeed, the burden is on prosecutors to find anything in the possession of the government that is favorable to the defense.

Michael Flynn, which will be decided on Tuesday, he ordered Mueller to provide the defense with all Brady material Last week, Judge Sullivan specifically ordered Mueller to produce any FBI interview reports — called 302s — or memoranda relevant to the original interview of Gen. Flynn. Ironically, Iowa Sen. Chuck Grassley has been requesting the agents’ notes and 302s for two years. Did Mueller comply?

Trump! When they are found to not exercise the rule of law the President must replace those responsible and the DOJ must bring inditements against the fired. Unfortunately, that aspect of our legal system exists only on paper. Prosecutors have never cared about guilt or innocence, or even justice. They care about WINNING and advancing their career, and if innocent people must suffer, well, too bad for them. Until they are held accountable, nothing will change.

Unfortunately, we have long been lead to believe that LEOs, federal agents and prosecutors are honorable men and women interested in the pursuit of justice. They have been given enormous power and have the ability to imprison nearly anyone if they use their full range of resources, use deception (yes, they can lie to targets and witnesses to gain “cooperation”) and exploit the superabundance of laws and administrative rules.
Juries need to consider nullification and closely scrutinize the tactics of investigators and prosecutors. They have to start losing cases. It’s not just the upper echelon that uses these tactics, the “rank and file” use them as well. Sorry Hannity, the rank and file want those salary increases and promotions and “judicial ethics” won’t stop them.
The GOPe continues to give Mueller top cover and because of that POTUS does not have the political capital to engage Mueller. Shame on all the AWOL so called GOPe conservatives who give aide and comfort to the Mueller Coup.
If Trump allows the democrats to continue being criminals, he will lose the 2020 election.

An investigation by the Justice Department’s watchdog into missing text messages from the FBI-issued cellphones of former investigators Lisa Page and Peter Strzok recovered thousands of text messages on agency-issued phones belonging to the pair.
But it did not attribute the missing texts to malicious intent on behalf of the two but rather a technology failure by the FBI’s tool meant to sweep up text messages, according to a new report (LINK TO REPORT)…
The gap in texts recovered from the pair’s phones coincided with a technical failure by an automated collection application that Assistant Attorney General Stephen Boyd said at the time was due to “misconfiguration issues related to rollouts, provisioning, and software upgrades that conflicted with the FBl’s collection capabilities.”
The inspector general’s investigation recovered around 9,311 complete text messages sent or received on Strzok’s phone that it was able to date to the period of the collection-tool failure, and around 10,760 from the same period from Page’s phone, the vast majority of which were exchanged between the two, which the inspector general said resulted in overlap for many of the texts it recovered.
An expert on Android phones obtained by the inspector general’s office was able to recover an additional 62 text messages during the period of the collection-tool failure and additional messages that fell outside of that window.
Those approximations include only text messages that a forensic analysis could attribute a date and time to, the report notes, and they also do not include fragments of text messages recovered by the investigation.
As a result of the investigation, the inspector general found a more widespread failure of the FBI’s collection tool than may have been previously known...
