Here’s What’s Weird About Robert Mueller’s Latest Michael Flynn Filing

Late Friday, Special Counsel Robert Mueller’s office filed its reply brief to the sentencing memorandum Michael Flynn had filed early last week with a D.C. federal court. Mueller’s reply brief revealed several new tidbits about the special counsel’s probe and the earlier investigation into Flynn, President Donald Trump’s short-lived national security advisor. Mueller’s filing came in response to a hastily issued order by presiding judge Emmet Sullivan, which directed the government to file its reply brief by 3 p.m. on December 14. Sullivan also directed Flynn to file with the court two documents he referenced in his sentencing memorandum: a January 24, 2017 memorandum authored by former FBI deputy director Andrew McCabe, and a FD-302 interview summary dated August 22, 2017.

Garnering the most attention was Sullivan’s order to the special counsel “to file on the docket any 302s or memoranda relevant to the circumstances discussed on pages 7-9 of the defendant’s sentencing memorandum.”

Did Mueller actually file the original 302's as required by the judge's order?

If Mueller did, why did he file them under seal?

Judge Sullivan has all of the security credentials to see all matters.

This game is “over” in fly-over country, but the left-coasters are continuing to move the goal posts and playing field.

He filed them under seal because there may be exculpatory evidence in the original 302s or its actually evidence in a criminal investigation against McCabe changing the 302s and so Mueller doesn’t want to be embarrassed or desire to throw out its prosecution of Flynn and give Trump a win and so he’ll rather have Judge Sullivan throw out the case because of sealed evidence and media continue the narrative

If Mueller had filed the original 302’s under seal, why didn’t Sullivan know about them last Wednesday at the initial sentencing hearing? If he’d known about them being filed, he wouldn’t have asked Mueller to produce them on Friday. Or am I getting something wrong here? I highly doubt that Judge Sullivan would have missed the fact that those documents had previously been filed under seal. He’s a smart guy.

I don't think Corsi is suing anyone. He merely filed a complaint with the DOJ's office expecting them to investigate. Good luck with the doj/fbi investigating the doj/fbi, we've seen this movie before.

That’s how I have seen it coming. He is going to let the judge throw out the case.

It will live on in the minds of moonbats who will say Flynn got off on a “technicality”.

Your points are well-taken and should have been understood by the author to leave out of her article that Mueller likely provided the original 302 under seal.

To impute that Mueller would do something by the book after we've seen lots of subterfuge and intransigence from him, with Judge Sullivan having to request "any 302s" suggests that it's likely Mueller did not provide the original Pientka 302, under seal or otherwise. If that 302 hadn't been provided to Flynn and the Judge by that point in time, that missing possibly exculpatory (Brady) information could well be sufficient reason for Sullivan to throw out the case and completely exonerate Flynn 12/18.

Why does Ms. Cleveland (and Mueller for that matter) not point out it was Special Agent Joe Pientka, Strzok's partner that filed the original timely 302 and that Sen. Grassley has been asking for these very things for two years from a non-compliant Mueller?

Why also has SA Pientka disappeared? All that is mighty suspicious that Mueller and the FBI have not likely been playing everything straight and by the book (duh).

The press long ago should have stopped associating the best of motives with Mueller's actions.

No one says there’s anything filed under seal and there was no numerical reference on the docket connected to this case filed Friday.

Only people here who go down the rabbit hole at a moment’s notice.
It gets tiring.

Journalists claim that journalists are objective, and if anyone questions a journalist’s objectivity they are read out of the journalism profession as “not a journalist , not objective.”

Objectivity is unnatural or even impossible. It’s unnatural because everyone has opinions, and everyone thinks their own opinions are right (or they wouldn’t be their opinions). Assuming your own objectivity is the essence of subjectivity, but seriously trying to be objective is hard. So journalists, who are in cahoots as described above, don’t even try. They just propagandize.

If journalists were actually trying to be objective (instead of just posturing), they would do as you say. But since journalists are Democrats, they don’t, and aren’t about to. It is no more complicated than that.

Bungling Bobby is far more corrupt than most people know. He’s also a crappy lawyer. Unfortunate combo for him.

He failed to turn potentially exculpatory evidence over to defense counsel. Absolutely illegal. Had the pettifogger had a scintilla of interest in actual facts, he would have had to acknowledge that there was never a case against General Flynn.

This is all third world crap. Judge Sullivan’s ruling will be quite significant. He *should* either throw the entire case out and sanction the holy hell out of the Mule Team; or, at a minimum, allow General Flynn to withdraw his guilty plea.
