He can LEGALLY us the military to build the wall, it IS National Security!!!!!
Congress doesn't just appropriate a sum to the "military." The defense budget is far more detailed-- $X for this weapon system, $Y for troops in Iraq, $Z for maintaining the submarine fleet, etc.
