The Supremes will throw out any challenge to this being justiciable because it is a political issue. They will tell Congress that they already spoke, in 1976, on this issue, when they passed a law concerning it. The only remedy is to pass another law countermanding the original one’s provisions on this matter...and good luck over-riding Trump’s veto even if they somehow do pass such a law in the first place (which isn’t likely AT ALL).
This is Trump’s, uh, TRUMP Card. Pun intended...and I hope that he uses it if he cannot get the Dems to agree to anything soon. It’d be just like him to say, “January 20 at noon is my drop-dead point. Approve funding the right way by then, or I sign an E.O. at 12:01 P.M., whether you like it or not. By the time it got to any court and was heard, the military will have most of the Wall built anyway (the Corps of Engineers built a 400-mile long highway in the Saudi desert in 30 half-days (they couldn’t build at night) during Gulf War I, a highway capable of handling tanks).
Agree, yet lower courts have intentionally delayed PDJT’s lawful exec orders; they will attempt the same over a border wall.
I was reading the stats the other day, some pretty frightening stuff: This fentanyl crap that comes from China sent to Mexico which is then sneaked across the border (tell me again how China isn’t trying to destroy us) This stuff has the potential to kill MILLIONS of people.
