This was my questions when it appeared that McCain’s illness took his health but more importantly took his cognitive functions, and it’s my question now. I’m not taking a side on this but I think it needs to be answered and applied evenly regardless of party or of the office;
When a representative (or appointee) has irreversibly lost their own personal ability to function in their office, but have not (yet) deceased, should subordinates and substitutes be permitted to function in their place, if that is their wish?
Moreover, how would we know it is their wish to have others serve in their stead, and how would we (or they) be able to validate that those serving in their place are doing so as capably and in the spirit of the way that the representative or appointee would.
Again, I’m not coming down on a side on this, but I am going to add on jab, and that is I believe people would be treating the question about a SCJ capacity to serve if the perception of their politics were on the other side.
