Kamala Harris: Documents (a British subject)?

Monday, January 21, 2019, California Senator Kamala Devi Harris announced her candidacy for the 2020 Presidential election.

Outstanding questions pertaining to her candidacy include her eligibility for this office. The US Constitution specifies only a "natural born" US citizen may hold this post. Definitions of that term, according to the intent of the writers of the Constitution, as well as some later court rulings, indicate this means "born to two US citizen parents." The requirement was intended so that only someone with undivided loyalties to the US, someone not with possible divided loyalties to other nations, could assume the title of commander-in-chief of our armed forces.

Actually, it was the Democrat convention’s job of to vette the candidates.

Pelosi did not vette, she certified the results of the nominating comittee as to who was nomiated.

I have the letter Pelosi sent to the Tennessee Elections Comission telling them who was the Democratic nominee

The 14th has nothing to do with the natural born citizen clause.

It has everything to do with it.

If you're a citizen at birth you're an NBC.

Pretty much by definition.

Found a source on the meaning of Ark: Natural born citizen. The last paragraph is how courts interpret Ark.

"Natural born citizen
Overview

A natural-born citizen refers to someone who was a U.S. citizen at birth, and did not need to go through a naturalization proceeding later in life. Political Office Requirement

The phrase "natural-born citizen" appears in the U.S. Constitution. In order to become the President or Vice President of the United States, a person must be a natural-born citizen. This "Natural-Born Citizen Clause" is located in Section 1 of Article 2 of the United States Constitution.

The constitution does not expressly define “natural born” nor has the Supreme Court ever ruled precisely upon its meaning. One can be a citizen while not being a "natural born" citizen if, for example, that person gained citizenship through the process of naturalization.

Under the 14th Amendment's Naturalization Clause and the Supreme Court case of United States v. Wong Kim Ark, 169 US. 649, anyone born on U.S. soil and subject to its jurisdiction is a natural born citizen, regardless of parental citizenship. This type of citizenship is referred to as birthright citizenship."

Nothing lawless about it. There are laws governing it. Those of us responsible for implementing and enforcing the laws would suffer the consequences of not doing so. Our elected representatives in Congress and the President are responsible for passing the policies and laws.

I’m glad this issue is being brought out, and the issue will probably not be resolved or 2020.

However, the controversy about this will cause any candidate who doesn’t meet the requirement to lose votes and take a lot of public criticism.

I welcome that, and it would a dream to see Harris get the nomination. I think she’s a long shot for the nomination, but Trump would easily dispose of this arrogant Leftist.

Wrong, Hamilton originally suggested
“citizen at birth” and that was rejected for the more restrictive “natural born citizen”.
Natural born citizens are naturally citizens because they can be no other.
Children of foreigners are born with other citizenships.
That is precisely who the founders were excluding.

It’s completely lawless and you know damn well it is. ‘Our’ bureaucracy has been giving birth certificates to illegal aliens ILLEGALLY for decades now. No law authorizing it. The 14th doesn’t. Congress never did.

I guess you missed the discussion of PDJT doing away with ‘birthright’ citizenship through an executive order. I wonder where he pulled that idiotic notion from? /s

Minor v. Happersett , 88 U.S. 162 (1875)

The Constitution does not in words say who shall be natural-born citizens. Resort must be had elsewhere to ascertain that. At common law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or natural-born citizens, as distinguished from aliens or foreigners. Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their parents. As to this class there have been doubts, but never as to the first.

Yeah, and as a little girl her mother took her to Canada, where she received all her schooling. Mother never became a naturalized American. She may have become a Canadian.

Technically, Shyamala Gopalan would have been issued an “alien number” with its own file within the USCIS. She likely also has a file somewhere in India, possibly with Kamala’s birth noted in it.

Here's Minor v. Happersett.

Happersett was decided March 29, 1875, and Ark decided March 28, 1898, 23 years later. So if there is any contradiction, between the two, Ark supercedes Happersett.

Except there isn't any contradiction. Happersett discussed citizenship but did not rule on it because it was about voting. Ark was about citizenship and ruled on it.

As in the explanation I provided, the courts interpret Ark to mean that birthright citizenship is natural born citizenship.

All we need is her parents citizenship at birth.

Should individual State Secretaries demand that ALL presidential candidates furnish certified copies of their parents' birth certificates prior to being placed on the ballot? Not just Harris but all of them? I mean, I haven't seen proof that Warren's parents were citizens? Have you? As far as we know, maybe her dad was a drunken mick stowaway.

Now, do you think this is going to happen?

The 14th is positive law. You can’t make anyone a natural born Citizen through declaring it—It’s self evident. Just as you can’t make a brown-headed cowbird an eagle by declaring it.
