Graham Calls on Trump to Declare National Emergency if There's No Deal to Fund a Border Wall After Three-Week Extension Sen. Lindsey Graham (R-SC) called on President Trump to declare a national emergency to fund a border wall if, after the three-week government funding deal that was announced Friday afternoon to re-open the government, the Democrats were still unwilling to compromise on wall funding.
“Come February the 15th, if the Democrats still say: ‘Go to hell on the wall, you get a dollar, that’s it.’ They basically tell Trump, ‘I’m not going to do with you what I did with Bush and Obama,’ then I hope he will go the emergency route,” he told Fox News.
The legality of such a move has been debated and President Trump did consider it during the longest government shutdown in history.
“We don't need to shut the government down, we need to secure the border,” Graham added. “And to me, the last best chance to do this win-win is between now and Feb. 15.”
Graham urged Democrats to negotiate with President Trump in the next three weeks, complaining that all House Speaker Nancy Pelosi (D-CA) has done on the border wall negotiations is “say no.”
"To my Democratic friends, you've voted for wall funding [in the past]," he pointed out.
“This president’s willing to give a better life to the DACA (Deferred Action for Childhood Arrivals), TPS (Temporary Protected Status) populations,” he emphasized, “the TPS recipients are going to lose their legal status and this president’s willing to work with them if he can get something in return: securing our border.”
Earlier this month, Graham made headlines for arguing that if President Trump caved on his $5 billion demand for border wall funding it would be the end of his presidency.
“If he gives in now, that’s the end of 2019 in terms of him being an effective president," he told Fox's Sean Hannity at the time. "That’s the probably the end of his presidency. Donald Trump has made a promise to the American people. He’s going to secure our border."
He didn’t. He’s supporting exactly what Trump is doing.
It is time. No more playing with the seditious DemocRATS. Just do it -— build the wall.

My two cents: President Trump took a licking yesterday and makes me wonder if he is up to the political side of his job. He has shown questionable judgment on his cabinet picks, in particular, AG and Director of the FBI. I voted for Trump mainly for his economic savvy and secondly for his promise of building a wall and draining the swamp. I want to see Obama, Hillary all those others perp-walked to prison. I want to see early morning raids like that imposed on Oliver Stone yesterday for a simple process crime. 50 arrests for every one of Mueller’s.
Trump has excelled regarding the economy, but he is a babe in the woods regarding the second. He has the authority; he just refuses to use it. He has plenary powers regarding immigration enforcement and has been told so by the SCOTUS and the Congress Research Group. The two-bit judges that filed injunctions against him slowed him down. Judges interpret the law, they do not make it, and Trump has to learn to understand that.
Forget the National Emergencies Act for how and instead use the Immigration and Nationality Act. 8 U.S.C. §1182(f):
“Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrant, or impose on the entry of aliens any restrictions he may deem to be appropriate.”
Trump has spent the last two years pretending he lacks the legal authority to stop the flow of illegal immigrants. When he used this authority, through executive orders, he instantly collapsed after the first injunction from Leftist judges when he should have told them to go to hell.
Mr. Trump: Shut down the border. Use the above-cited authority plus 10 USC 284: Support for counterdrug activities and activities to counter transnational organized crime. This act authorizes the military to erect walls without congressional authority to deter drugs from entering our country. And also, Mr. Trump, don’t ever let Nancy Pelosi get the better of you.
There is no amnesty deal in using emergency powers to build the wall.
Will the President have any other choice?
If Senator Graham wants to stick his neck out for the wall, instead of stating the obvious, he should recommend that the coming court order to halt the building of the wall be ignored.
It amazes me at the absence of rational thought displayed here.

All Trump is doing is ending the continual “Kabuki theater” being perpetrated by Pelosi.
He knows that this tit-for-tat will never end, and it’s the workers who are suffering from it.
So, in a perfectly executed “ju-jitsu” move, he’s using her weight against her...a “rope-a-dope”.
I don’t think he would have played it this way if he doesn’t have one hell of a “plan B”.
I think Nancy will rue the day she tried a power play on Trump.
This time she might get more than a “flight” cancelled.
Never thought I’d live to see the day when Lindsey Graham showed more backbone than President Trump.

You must have missed this part. Graham never wanted President Trump to cave on the shutdown in the first place.

I think Congress all along has wanted Trump to do that, so they could avoid making a decision. They can then stand on the sidelines and watch Trump and the Ninth Circuit argue.
