The problem with a National Emergency declaration is that a liberal judge somewhere will overturn it in 5 seconds..it goes to the Supreme Court, and it will be 5-4 against Trump because Justice Roberts is a sh*thead

I think this may mean that Trump knows RBG is at room temp...or soon will be.

Trump is no fool....

Trump has discovered some serious leverage somewhere is my guess.

Perhaps. But since there’s an explicit Congressional dispute path, my understanding is that path must be completed before the issue would be ripe for a court to hear.

Besides methinks this declaration would easily pass the rational basis test.

Under your premise, all existing national emergency declarations (30 still in effect since 1979) must also be declared null and void. You cannot have it both ways. Congress gave this power to the Executive branch. The SCOTUS cannot pick and choose which ones will have standing and which won’t. That would be exercising power outside of their jurisdiction.
