It is perfectly legal to make profit off land that has an easement. For instance I have some land that has an easement on it to allow access to a parcel of land that is used to grow trees for lumber. About every ten years they go in and re-clear the access road and make a timber cut. The timber cut takes about a month and then they leave for another 10 years. I knew about the easement when I bought the land and it has been a win win. The timber owners have land that is protected from lumber thieves because of limited access (They always call and make arrangements months before re-opening the road, so if anyone tries to reopen the road, I will know that someone is attempting unauthorized access.). And I have land that abuts my property that will remain undeveloped; which is what I want.
We have adjusted the easement, so the road has been moved to a route that I can use a portion. They like the idea, because they would only have to clear a shorter portion on future timber cuts and I like it because they paid for making me a road that I wanted. Therefore I have "profited" from the easement.
Gov Abbot should make it so. ;-)

I wonder if President Trump could instruct the Department of Justice to in effect Aid people suing the federal and state governments. It seems that the state or local government should be liable for damages if the criminal Invader was released from custody when it was known they were here illegaly. I would think that both the federal and state governments would share in liability. If it was the state government refusing to abide by federal statutes, they should bear 99% of the damages. United States federal government could acknowledge a small portion of the damages. The DOJ attorneys could then assist the family’s legal team in establishing that the state or local officials did wilfully and intentionally ignore the requirement of turning the detainee over to the federal government for the deportation process.
Funny how the headline leaves out the “an environmental group” as the actual descriptor of them “Texas Landowners”.....
She should just be glad they aren’t building a super collider on her property....
