Jonathan Turley on Trump’s emergency declaration: ‘Democrats will lose’ on merits of case

George Washington University Law School professor Jonathan Turley, a noted constitutional expert, explained the difference on Friday between President Barack Obama’s legal case involving lawsuits against Obamacare and President Donald Trump’s national emergency declaration.

“They’re using the case where I represented the House of Representatives against Obamacare. And we won. But this is not the same case,” Turley said on “Fox & Friends.

“What President Obama did was order the Treasury essentially to be opened up and to pay insurance companies. That’s a different type of funding.”

“What Trump is going to do is he’s going to use money that was appropriated by Congress. It just doesn’t have these tight conditions on them. That’s Congress’ decision to make. They can appropriate money and not put many conditions on.

“So it’s going to be a different fight,” Turley continued.

perhaps but i doubt ANY judge would risk his/her career trying to stop a Commander in Chief from defending America from an overt invasion

But it's not about the merits, it's all about leftist power.

This will go to the Supreme Court and Roberts will decide it unless RGB takes a dirt map before it gets to them.

Just watched the replay of Journal Editorial Report. They all seemed to think it was a big mistake for Trump to declare a national emergency.

The JER isn't known for being pro-Trump, but they avoid the extreme anti-Trump hysterics of most of the comparable programs and they are often good on stories which don't involve Trump. Daniel Henniger is usually on and usually level-headed but he wasn't on this weekend's report. Instead there was some young man I had never seen before.

The turtle should immediately bring to the senate a bill which challenges Khal Donald’s Emergency declaration. Let’s see who will vote against it.

Legally, the dems can’t even bring the case until Trump starts spending the emergency money in the 9th Circuit states. And if Trump doesn’t spend any of the money in the 9th circuit states, they would be forced into the other border circuits. But when does legally ever stop the dems.

They will find several judges who will be more than willing to execute a corrupt bargain with the Democrats. But, the attempts will be quickly swept aside probably without any effect on the schedule. The Supreme Court will defer this question to the electorate in the 2020 Presidential Contest.

I can see you’re a person who knows the value of picturing the ball going through the hoop before taking the shot.

IMHO, that’s walking in dimensionally-aligned light, as in 1 John 1:5-7 and Rev 1:10. You avail yourself of divine intervention through guidance and assistance, not to mention renewed salvation and fellowship with Him and one another.

The Democrats own a lot of Judges at the district level. Common sense tells us that a district judge does not have the authority to bring injunctions & stop orders against the president. However everyone acts as if they do.

The Democrats have spent at least the last 50 years packing all levels of the federal court system with their toadies.
Every time during the Carter Administration, during the Clinton Administration, during the Obama Administration that an activist judge who rules from the bench was appointed the Republicans, in the interest of getting along, approved it.

Now we are paying the price for the Mitch McConnell’s of the world.
