I’m no lawyer, but Sharpton may be very sorry he called for “maximum” punishment since the “white powder” threat letter could well be charged under the “terroristic threat” statute that specifies up to 10 years in prison:

While Jussie’s lawyers may try to argue that he can’t really threaten himself with a hoax, reportedly the letter caused a HazMat response at the studio for the Empire show.... so presumably there was some degree of evacuation and major official response to the “threat”.... which seems to meet multiple prongs of the legal criteria (at link).
