Collins' lawyers to N.Y. prosecutors: None of your business

Rep. Chris Collins' lawyers appear to be honing a new argument to press against the federal prosecutors in New York who charged the Republican lawmaker from Clarence with insider trading: It's none of your business. That's the key new message underlying a host of legal documents the Collins defense team filed in federal court in Manhattan earlier this month. Why, the Collins defense team appears to be asking, is Collins being prosecuted in U.S. District Court in the Southern District of New York for an alleged violation – launching a series of insider stock trades – that supposedly started with a phone call the congressman made from White House lawn in the nation's capital?...(snip)

...The congressman has long vowed to fight the charges in court, and in the new legal papers, his lawyers repeat a point they have been making since the start of the case: that he didn't sell any of his Innate stock at the time and therefore didn't benefit from any alleged insider trading scheme. "The indictment fails to allege the nature of any personal benefit that Rep. Collins expected to receive from the alleged actions," the Collins lawyers said...

I kind of thought that was my initial point.

Judicial Immunity....something that doesn’t actually exist but judges have claimed it and it’s accepted.

Prosecutors can be held accountable, but it is very, very difficult. Nifong is a perfect example. He should have went to prison for as long as those boys were looking at, for what he did to them.

There are many others. These people put their pants on the same way you and I do. And it’s sickening to see them act as if they were above the law, which in so many cases, they darn sure seem to be.

As for Wiseman and all the lives he has ruined, I think we’re long past solitary confinement and well into that area where the Tree of Liberty needs to be watered.

How so?

Do you even know what “insider trading” is?


It’s moot - Congressional members are exempt from insider trading laws.

Recently I saw one of those little boxy bags that Louis Vuitton makes. The end of it has an opening that the little critter it’s made to carry around can look out at. $2,500 to cart around a little yapping poodle.

I looked in the bag and saw Trey Gowdy.

I agree. Prosecutorial immunity is an issue that needs to be revisited. Nifong was an egregious anomaly. Over time, prosecutors have appropriated more unchecked power. If there isn’t a regular means of holding prosecutors and investigators accountable, the abuses will only get even worse.

I think we are clearly at that point and we need a regular means of policing these people that goes beyond jury nullification. Civil suits against prosecutors should be accepted at a lower threshold by courts. Rules against flipping witnesses, abuses of 4th amendment, and withholding exculpatory evidence need to be regularily considered for license revocation at state law boards.

Absolute power corrupts absolutely. Prosecutors and investigators should be on notice that the public will not tolerate judicial tyranny.
