This brings up a question: If there are any places where the wall has to be placed *north* of the actual border for a distance of, let's say two feet or more, then what is the legality of an MS-13 gang member's 9-month-pregnant girlfriend laying down on the Mexican side of the wall right up against the wall but actually in US territory, and begatting an Anchor Baby?
Probably perfectly legal at the current time - but unfortunately that’s nothing that the President can do anything about at the present time. This is strictly and specifically in the hands of Congress.
The primary (first) barrier is routinely constructed a few feet North of the actual border, to provide some right of way for maintenance.
As a practical matter though, I don’t think that squatting next to fence to pop out a few bambinos would actually work for citizenship. Nobody is there to certify your birth certificate.
No doubt, they would be "deemed" a U.S. citizen by some judge due to the bastardization of our 14th Amendment.
However, if we can cut off 95+ percent of the tens of thousands flooding in monthly, it will be a major win. Then, once the bleeding is stopped, we can go for total victory and get our courts and our congress to revert back to the original intent of the 14th.
That last 5 percent of the battle will take a while fighting not only uphill as we currently are, but also with one arm and one leg tied behind our backs.
