it is fascinating, imho, that the proponents of this scheme deliberately avoided any of the several constitutional means for getting what they wanted

Seems to me that non-signatory states should take the compacting states to court.

Most other analyses miss the key issue emphasized here: Can the states bypass the Constitutional amendment process when they object to a provision of the Constitution in a case that clearly contradicts the Founders’ intent?

The answer is that they cannot, at least without nullifying the rest of the Constitution as well.

Too many people argue secondary issues instead of this main one.

Also, each state was guaranteed a “republican form of government.” This pact changes the state into a Hugo Chavez style democracy, where 51% dictate to the 49%.

I would think a SCOTUS vhallenge could not fail ss long as the EC remains in the Constitution. The states elect the POTUS: that is accepted by these advocates. Well if the state runs an election for presidential electirs and candidste X wins but the electors for losing candidate Y are chosen to vote then the majority of state voters have had their vote erased. Thus a state has ignored the voters in favor of voters in other states. This flies in the face of one man one vote as the votes of many are ignored. I cannot see less than a 7-2 with only RBG and Sotomayer dissenting.

While the NPV is a horrid corruption, it doesn’t violate Article II or Article IV. Scotus loves democracy and elevated voting to a fundamental right.

The Port Authority of New York & New Jersey (which controls bridges,tunnels and airports in the "Tri State" region) is a "compact" approved by Congress,as required in the Constitution.

This fraudulent plan isn't...and won't be.
