When I moved to a new town, I had to prove residency in the county to check out a book at the library. You'd think election to state government would be a little stricter.

Even though Cheney had a previous long time connection to Wyoming, I think when W selected him his residency was actually Texas. Via the USC you can’t have P & VP from the same state. They had to “scramble” to my mind “unconstitutionally” to make him eligible for VEEP. Before anyone gets “too hot & bothered” about it being “W” its happened before. It doesn’t make it right but there was precedent. And yes bad precedent! I think Cheney found a broom closet in Wyoming to rent. One of the many examples where the parties play “fast & loose” with the USC to keep power.

Technically, a President and Vice-president can be from the same state. Electoral College electors cannot vote for more than one candidate from the same state as themselves.

This would have disqualified Texas electors from voting for Bush and Cheney.

Article I, Section 2, Clause 2:

No Person shall be a Representative who shall not have attained to the Age of twenty five Years, and been seven Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State in which he shall be chosen.

The Constitution merely requires a Congressional member live in the same state — not same district — they represent. Mad Max could live a mile south of the Oregon border and still legally represent South Central L.A. However, if she lived on the opposite side of the state line, she cannot. If McBath is a TN resident, she is illegally occupying a House seat.

IF Maxine Waters can cheat about residency, then every one else can.......


I understand that California law does not require Representatives to live in the districts they represent—and the Constitution does not require it either. But the Constitution does require one to be a resident of the state one represents. I wonder if this has come up before and how it was resolved.

It shouldn't have to go to the courts if it is as plain as day.

Article I Section 5 states that the House is the judge of its own qualifications. If they are honest, they would judge that the Georgia seat was filled unconstitutionally and vacate the seat.

A court cannot vacate a seat, as that is not an Article III power, since Article I already has the remedy.

The only play for Democrats is to force the states of Georgia and Tennessee to both declare that this woman was a primary resident of Georgia and not Tennessee. Otherwise, by the states' own declarations, she is unconstitutionally seated and Pelosi's oath of office would force her to do the constitutional thing remedy the situation.

That would be to vacate the seat and have Georgia call for a special election. To do otherwise would really hurt the Democrats because it would another very public display of one rule of law for Democrats and another rule of law for the rest of us.

The late G HW Bush at some point during the Reagan years (maybe before!) was in danger of losing his Texas residency. I read he solved it by renting a hotel room in Houston. I am not using this bash to GHW. I just in general don’t like this type of Constitutional trickery no matter who does it! It makes it hard to argue the natural born citizenship issue. (Yes you and I see a big difference but many don’t particularly if your side played “fast & loose” with a constitutional requirement!)

Well, we both know they aren't honest, so there goes that approach to solving the problem as it should be solved.

When have we seen that? Republicans are all about reaction not action! In politics as in war you make the enemy react to you not you react to the enemy.

Too many Republicans get fat and satisfied once in office, become nothing more then a full tick!
