Colorado enacts 'red flag' law to seize guns from those deemed dangerous, prompting backlash
Fox News ^ | 4/14/19 | Gregg Re

Colorado became the 15th state on Friday to adopt a “red flag” gun law, allowing firearms to be seized from people determined to pose a danger -- just weeks after dozens of county sheriffs had vowed not to enforce the law, with some local leaders establishing what they called Second Amendment "sanctuary counties."

The law didn't receive a single Republican vote in the state legislature, and has led to renewed efforts from gun-rights activists to recall Democrats who supported the measure. In a fiery and lengthy statement on Facebook on Friday, Eagle County, Colo., Sheriff James van Beek slammed the law as a well-intentioned but "ludicrous" throwback to the 2002 film "Minority Report," and outlined a slew of objections from law enforcement.

Van Beek charged that the law treats accused gun owners like "criminals," discourages individuals from seeking mental health treatment, and ignores the reality that "a disturbed mind will not be deterred by the removal of their guns."

Who is actually going to go to court to try to get such an order on someone else? Few will bother.

It won't take more than a few.

Vindictive ex-spouses or girlfriends will be the first ones in the queue. They will get a sympathetic judge to authorize a pre-dawn raid on their former partners. The media will vilify the defendants. If that goes well, they will expand the program.

Denver or Boulder police officers will be ultimate complainants , using the EPRO to target political opponents of the State Government. I would expect an EPRO raid on Jon Caldera's house within the year.

Somebody will inevitably be killed in a raid. A bunch of Democrats must be recalled over this "law". And it must be repealed.

Supposedly this law presumes that you are guilty until proven innocent...which if true will not survive a constitutional challenge........

Hope you’re taking that threat seriously. Document it with a notarized letter and give copies to trusted family members. Given that your niece is a leftist nut case, I’ll bet she’s bragged to more than a few of her pals how she shut you down. Any one of them could easily make the call too.

I am really surprised that these “Red Flag” laws have not been challenged in the courts. IMHO, they are unconstitutional in several respects: https://www.usatoday.com/story/opinion/2018/04/19/red-flag-laws-strip-gun-rights-violate-constitution-column/526221002/

Any FReeper lawyers care to respond?

I have removed her from ‘immediate family’, spoke with her father too.
Funny, her dad owns the safe my ‘overflow’ rifles end up in.
Don’t get me started on the boating accident...
She had a California education.

The President said he is in favor of gun confiscation w/o due process, too.

“Take the guns first. Due process second.”

I engaged a clueless apolitical person...not long ago.

#1...pointed out to her OK..is now open carry/right to carry. She said...."That's scary....!!" I said...you think a criminal follows the laws now?

She looked confused...and said no they don't. BINGO!!

#2 We talked about this "red flag" BS....she thought it was a good idea.

I asked her did she have any people that didn't like her or her husband. She said yes.....

I asked her,...."Do you think people would turn in people they didn't like....because they knew you had guns...but no real reasons?"

She said...I had a point.

In theory/other times this law is a good idea. Kinda the way it was back in the day. Normal people knew who in their community were the idiots, potentially violent people, and keeping them from having guns would be a good idea. The town drunk, that beat his wife, everybody knew he shouldn't have a gun.

But in 2019, with thought crimes basically a thing, liking Trump or thinking we should have a secure border is now "crazy", and I fear for gun confiscation of people who hold different political opinions. And that sucks. Because I do not want guns in the hands of truly crazy, violent people. But I don't want the people that tend to hold seats of power in government nowadays deciding what is "crazy".

I hate to say it but Deaf Smith has a point, and I can testify to it from experience, though I will not do so at this time. As we are getting into families being divided three against two and two against three, father against son, son against father, and the state is right there in the middle of the whole thing.
