Like every other country in the world, the U.S. government has the legal authority to monitor any foreign communication it pleases, including communications crossing U.S. borders, i.e., when one party is within the U.S. There is no way of knowing whether or not the party in the U.S. is a U.S. person, or a member of al-Qdeada.
