Still not a clean case. How would he know her status? It’s a he said she said. Don’t get me wrong, I believe her, but it’s not a great case for rape.

Think about the mechanics of the situation (spooning leads to forking, as they say). Approached from behind, a drunk or groggy girl might not realize it at first.

Smart girls don’t sleep in rooms where strange men have access to her. One of the problems with modern life is that people are entirely to casual about it.
