When media CEO/Publisher e mails are supeanoed and found to contain correspondence with various FBI/DNC plotters, they become guilty of conspiracy.
Conspiracy is not protected by the first amendment. They can say what ever they want, but they can not engage in the plot ot overthrow the government.
You are right and that is why they are worried. Conspiracy and bribery have rather steep penalties.
