9th Circuit blocks emergency funding for border wall, as White House vows appeal

The 9th Circuit Court of Appeals on Wednesday upheld an injunction barring the Trump administration from repurposing approximately $2.5 billion in Pentagon money to the Department of Homeland Security to build a border wall with Mexico, prompting the White House to promise an immediate appeal.

A divided three-judge panel on the appellate court agreed with a lower court ruling that prevented the government from tapping Defense Department counterdrug money to build high-priority sections of wall in Arizona and New Mexico.

In February, Trump ended a 35-day government shutdown after Congress gave him far less than he wanted. He then declared a national emergency that the White House said would free billions of dollars from the Pentagon.

In its ruling, the 9th Circuit panel noted that Section 8005 of the Department of Defense Appropriations Act of 2019 "authorizes the Secretary of Defense to transfer funds for military purposes if the Secretary determines that the transfer is 'for higher priority items, based on unforeseen military requirements' and 'the item for which funds are requested has [not] been denied by the Congress.'"

How the hell does ANY court claim jurisdiction over the budget directed to defend sovereign borders?

Trump needs to call the Ninth out on this, build the damn wall, and to hell with those black-robed tyrants.

We don’t need SCOUTS or anyone else to allow the government what the Constitution MANDATES they do: PREVENT INVASION!!! (U.S. Constitution, Art IV, Sec 4). (Illegal immigration and immigration of our enemies is invasion.)

Unconstitutional court decisions should be ignored and nullified and Trump should show his constitutional right to move forward and MOVE FORWARD with the wall regardless of unconstitutional judicial decisions!

The Constitution trumps the courts and the Constitution, NOT the courts, is the Supreme Law of the Land (Art. VI, Cl. 2).

Doesn’t the law read: “as the Commander in Chief deems necessary..” Or language to that effect. Pretty clear cut to me.

The Commander in Chief has declared a national emergency.

A court of appeals overrides his authority.

To let this stand would set a precedent denying a president to execute his sworn duty.

To allow this to stand would mean the courts would decide what is a national emergency and what is not.

The president has the power to respond to emergencies under the Emergency Decl act of 1974. The congress has the right to over rule the declaration. They tried and failed.

There is no role for the judiciary in emergency declarations. You can’t provide for the national defense of 200 federal judges can individually or in small panels overrule the president who its commander-in-chief.

The president should stop responding to the court and make a statement, but starting with the immigration restrictions from terrorist counties he had deferred to the courts on matters of national security.

What will he do when the USSC votes 5-4 to not fund the wall?
