It's my understanding the constutution says counting persons, not specifically legal citizens. That is the next legal battle battle - should non citizens be counted for representation?

That's a very good question. IMHO not a good idea to count non-citizens. It's like the definition of "natural born citizen"—the founders didn't nail down some important ideas.
