What bureaucrat decides someone is a threat and should have their weapons confiscated?
A neighbor or associate of a potential home invader would decide by filling out a form with accusations on it. A judge would simply order it. While the order is in effect for months during an mental evaluation, criminals would have free reign over the accused.
