What should have been invoked is rebus sic stantibus, since that would make the entire sick treaty invalid.
Ever read Article 50? It gives all the advantage to the EU when it comes to negotiations like this. There was no Article 50 in the treaties when Greenland voted to leave the EU (then the EEC)not that they truly are out of the EU due to their connections with Denmark and thus being one of that empires overseas countries and territories.
