Official: Trump to challenge California authority on mileage

The Trump administration is moving forward with a proposal to revoke part of California’s authority to set its own automobile gas mileage standards, a government official said Thursday, confronting a state that has repeatedly challenged the administration’s environmental rollbacks.

The Environmental Protection Agency was preparing paperwork for the White House for the move, meant to help the administration set a single, less rigorous mileage standard enforceable nationwide, according to the official, who is familiar with the regulatory process and spoke on condition of anonymity because the plan has not been made public.

President Donald Trump has pushed for months to weaken Obama-era mileage standards nationwide and has targeted California’s decades-old power to set its own mileage standards as part of that effort.

Administration moves to rescind authority that Congress granted probably would end up in court. When President George W. Bush challenged California’s greenhouse gas emissions and mileage-setting ability, California fought it. The Obama administration subsequently dropped the Bush effort.

The Trump plan would have to be posted in the Federal Register and would be subject to public comment. …

You’d think that any State in the union has substantial latitude in regulating products which are sold there, however in the case of gas mileage restrictions on automobiles it is an unavoidable consequence that because California is such a huge market, its draconian demands on the industry result in the rest of the States being burdened and inconvenienced due to the need of the manufacturers to have assembly lines produce cars which are compliant to California’s ridiculous requirements.

This isn’t a bad effort to pursue, but it won’t mean anything in practicality. The car companies won’t actually make changes to their plans unless they can be sure that the changes will stick after Trump leaves office, and with the environmental zealotry on display on the left, this executive effort would be rescinded purely out of spite as soon as a democrat reached office. Secondly, though sort of on the same line, California would have no incentive to respect the grandfathering of any non-conforming vehicles sold during the possible years where they were ok to be sold within California. Registrations could be refused and knowing this would be possible, Californians wouldn’t buy them. That said, it would be worth pushing through the courts just to find out where federalism’s lines can be drawn for interstate commerce.

A lot of people died due to these mpg regulations. Instead of being protected by steel it is replaced with plastic to lighten the car . To bad we can't charge the RATs responsible with murder.

The car companies seem to have accepted the California requirements. As they must plan models years in advance, they don’t have much room for maneuver. They know Trump is temporary and California is permanent.

It's a fair point to debate, though there are clearly some issues that have national scope/implications that the Founders could not have foreseen - an automotive industry being one, air travel being another.

I believe it's reasonably arguable that having national standards for vehicle quality, construction, safety/amenities (e.g., seat belts), and performance makes sense from a practical point of view since there aren't 1,000 different vehicle manufacturers scattered around the country. Using the Interstate Commerce clause to make this happen feels like a reach to make that happen, but we've seen worse abuses of that principle.

Or you can have a Tahoe that cost over 50K, blow up due to a defective crank shaft that cracked at 80,000 grandma miles, a $7,000 rebuild.

We called GM, it was not under warranty and the guy we spoke to admitted due to EPA regulations on car mileage, they have been forced to use more inferior products to build our cars. Not steel!

Its not just cars, its EVERYTHING...

They declare something has to be some way to sell in that state, industries capitulate so they don’t have to pull out.

Farming/Agriculture etc is another area where this sort of nonsense happens.

Yep. Because of EPA regulations heat transfer tubes in air conditioning have the be made thinner in order in increase heat transfer and efficiency. So it breaks sooner.Designed obsolescence used to be something leftists accused corporations with. It's leftist government meddling that is the real villain!

At the very least, Wickard v Filburn ought to apply. If Kalifornia requires 57 MPG or whatever, that affects the ability of people in the other 49 states to buy cars.
