As far as I know, the proposition that the 14th Amendment makes anyone born in the United States a citizen has never been cleanly tested in the federal court system.
The contrary proposition (that 14th Amendment citizenship requires more than just birth in the United States) has a lot of merit.
The problem may be that the federal government has grown so accustomed to pretending that anchor babies (even a stone cold killer terrorist — Hamda i think, or Hamza? — whose non-citizen parents ditched the country weeks after he was born was simply assumed by the Supreme Court justices to be a U.S. Citizen when his case reached their court on appeal) are U.S. citizens it doesn’t have the courage to face the truth at this late date.
And it may be that no other entity has standing to sue over the question. So we float on into the future with no satisfactory resolution. Unless Bad Orange Man decides to do something about it.
