Romney: Whistleblowers ‘Should Be Allowed to Remain Confidential’

While speaking to reporters on Tuesday, Senator Mitt Romney (R-UT) reacted to calls to reveal the whistleblower’s identity by stating that whistleblowers, especially those speaking about government action, “should be allowed to remain confidential.”

Romney said, “My own view is that whistleblowers, particularly those that are blowing whistles on action within the government, should be allowed to remain confidential.”

Remaining confidential is contrary to our Constitution.

The Confrontation Clause of the Sixth Amendment to the United States Constitution provides that “in all criminal prosecutions, the accused shall enjoy the right…to be confronted with the witnesses against him.”

Mittens, the Whistleblower Protection Act of 1989 protects whistleblowers from workplace retaliation for reporting malfeasance.

It does not and never has protected the whistleblower's identity.

5 U.S.C. 2302(b)(8)-(9)

(8) take or fail to take, or threaten to take or fail to take, a personnel action with respect to any employee or applicant for employment because of-

(A) any disclosure of information by an employee or applicant which the employee or applicant reasonably believes evidences-

(i) a violation of any law, rule, or regulation, or

(ii) gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety,

...

(9) take or fail to take, or threaten to take or fail to take, any personnel action against any employee or applicant for employment because of-

(A) the exercise of any appeal, complaint, or grievance right granted by any law, rule, or regulation;

(B) testifying for or otherwise lawfully assisting any individual in the exercise of any right referred to in subparagraph (A);

(C) cooperating with or disclosing information to the Inspector General of an agency, or the Special Counsel, in accordance with applicable provisions of law; or

(D) for refusing to obey an order that would require the individual to violate a law;

Nowhere does it say that the identity of the employee must be withheld.

Not sure exactly how it works in impeachments - but wouldn’t the right for Trump to confront his accuser embodied in the 6th Amendment come into play here? Or would that need to wait for the Senate phase.

Was Harry Reid a whistleblower when he claimed Romney didn’t pay taxes?

So many on FR leaped to Romney’s defense, calling dingy Harry a liar. But how do you know he was lying? Because Romney was the GOP nominee? That means we must defend him without knowing the facts?
