Tacoma, Washington Gun Tax Based on False Premises

In Tacoma, Washington, the City Council is proposing a special tax on guns and ammunition. From q13fox.com:

Tacoma is considering implementing a tax that would add $25 to all firearms purchase. The tax would also add 2 cents per round to ammunition purchases that is .22 Caliber or less and add 5 cents per round to all other ammunition.

Such a tax should be held unconstitutional because it chills the right to keep and bear arms, protected by both the U.S. Constitution and the Washington State Constitution.

The proposed tax seems to violate the state preemption statute.  From leg.wa.gov:

RCW 9.41.290

State preemption. 

The state of Washington hereby fully occupies and preempts the entire field of firearms regulation within the boundaries of the state, including the registration, licensing, possession, purchase, sale, acquisition, transfer, discharge, and transportation of firearms, or any other element relating to firearms or parts thereof, including ammunition and reloader components. Cities, towns, and counties or other municipalities may enact only those laws and ordinances relating to firearms that are specifically authorized by state law, as in RCW 9.41.300, and are consistent with this chapter. Such local ordinances shall have the same penalty as provided for by state law. Local laws and ordinances that are inconsistent with, more restrictive than, or exceed the requirements of state law shall not be enacted and are preempted and repealed, regardless of the nature of the code, charter, or home rule status of such city, town, county, or municipality.

When Seattle imposed a tax on guns and ammunition, the Washington Supreme Court has held a tax on guns is not a regulation of guns.  It upheld the ability of cities to tax guns and ammunition in 2017.

Further PROOF that Democrats know taxes reduce commerce, even though they deny it when they tax corporations.

How about a $50 tax on every abortion?

We can play this game.

Yes, exactly.

One judge on the Washington Supreme Court dissented, and openly showed the emperor was naked.

The rest of the Court simply ignored him, essentially thumbing its nose at the Legislature.

All those judges should be impeached.

They won't be, because the Court knows the Media has its back.

Guess it hasn’t occurred to those idiots that gun owners merely drive outside the city limits to buy their ammo....🙄

Chicago was SHOCKED that most of their population would go to Indiana to buy cigarettes and soft drinks after they put a massive tax on them. The mayor (might have been Rahm Emanuel) wanted Indiana to collect their tax. LOL!

Crap, that is something like a 25% tax on 9mm FMJ. Just another reason to buy ammo online.

I wonder if the online ammo sellers have a lobby involved in this.

Or that they can buy online. And that when you buy online, you are forced to buy bulk to mitigate shipping costs. So this will just lead to gun owners with more ammo laying around, not less.

Taxing abortions would be patently unconstitutional. Abortions are a right guaranteed as a penumbra of the “right to privacy” which, although not directly stated is kind of implied by the 4th amendment.

The right to firearms is only briefly mentioned by the 2nd amendment and the words “people” and “shall not be infringed” do not mean what you think they mean.

They also wanted Indiana to enact a bullet tax and give the money to Chicago. That is the current Mayor.
