If federal prosecutors made such a basic blunder concerning key evidence, what other mistakes lay buried in the undisclosed evidence?

After a flurry of court filings and blockbuster developments last month, the Michael Flynn criminal case has been dormant for nearly three weeks. The parties and the public now await word from presiding Judge Emmett Sullivan on the pending motion to compel and motion for sanctions filed by Sidney Powell, the lead attorney who took over Flynn’s case shortly after the special counsel team disbanded.

I think this is a Judge only trial with no jury. The Judge is very suspect. I remember Trump sent back a bunch of non citizens and this Judge tried to order the plane to turn around when they half way back to their country.

There's no jury because there is no trial. Flynn pleaded guilty in his case almost two years ago. This is all a bunch of legal and bureaucratic machinations over his sentencing.

It really galls me how profoundly conflicted his former law firm was, and they never even disclosed it to him, while shaking him down for several million dollars in fees they earned on false pretenses. When this is all over he ought to sue them for malpractice, including compensatory and punitive damages and break the whole damn firm.

Since he has not yet been sentenced he can withdraw his plea. So far he and his attorney has not taken that step. He did file a motion to compel the US Attorney to provide exculpatory evidence that could provide a basis for an outright dismissal. That motion to compel is what is being considered now.

The Judge in this case, Emmitt G. Sullivan was also the judge in the Sen Ted Stevens case in which he overturned Steven’s conviction because the prosecutor withheld exculpatory information. He also ordered the DoJ to conduct training of their attorney’s in Brady procedures. So he may not be too happy to see the DoJ doing the same old thing.

His lawyers don’t want to withdraw the plea. They want to get the charges dismissed with prejudice so: (1) they don’t have to even bother with the prospect of a trial, and (2) they can potentially have a judicial finding of prosecutorial misconduct that allows Flynn to sue the DOJ for compensatory and punitive damages.

Ah yes that’s right I’d forgotten for a moment. So much to keep up with these days. Wasn’t there a move to withdraw the guilty plea since Muller had a gun to Flynn’s son’s head?

Didn't he do this to stop the hemorrhage that had already ruined him and his family? They should toss out his plea, reimburse him for every nickel, find the guvmint lawyers in contempt and put them in jail for as long as the law allows.

Yes and, far worse, he was being shaken down by his own lawyers who were so conflicted they were ethically obligated to withdraw and didn't. That meant they couldn't mount an effective defense and were, in effect, collaborating with the totally corrupt Special Counsel in extorting him into an invalid guilty plea. Those massive attorneys' fees were instruments of extortion to force an invalid guilty plea. Thus, those attorneys and their whole firm, ought to be sued for horrific, deliberate, gigantic malpractice, including compensatory and punitive damages.
