We keep on hearing how the impeachment hearings are going to backfire on the RATs but where is the evidence? Wishful thinking, I guess.
The proof of the pudding won’t finally be in until Nov 3, 2020 (or conceivably Nov 4).

My opinion is that Republican pols must sue the MSM for libel, in the teeth of New York Times Co. v. Sullivan. That unanimous decision by the Warren Court hinges on a false claim about the Constitution, and it must be overturned.

Scalia pointed out that the reason for the Bill of Rights was that they were the price of ratification of the Constitution by some of the states. The intent of the First Amendment and the entire Bill of Rights was not to increase or to diminish any right. The entire intent of the First Amendment was to assure that the skeptics of the Constitution should have no occasion to charge that the Constitution denigrated any right.

“The” freedom . . . of the press was not a novelty during the passage of the Bill of Rights, “the” freedom of the press was freedom as it was known and understood. IOW, freedom as limited by accepted rules against libel and pornography. That is why courts exercise themselves over “accepted community standards” related to pornography cases - and why nobody thinks that the press has a right to libel ordinary people without consequence. The distinction of libeling your neighbor being actionable but libeling your Congressman being “No harm, no foul” is legislation by the Warren Court. “The” freedom of the press did not license anyone to libel anyone else.

The conclusion, Scalia asserted, is that the First Amendment was crafted to not touch the law of libel. And that in asserting that

". . . libel can claim no talismanic immunity from constitutional limitations. It must be measured by standards that satisfy the First Amendment”
Justice William Brennan and the entire Warren Court erred in Sullivan.

IMHO Sullivan is the engine of Political Correctness, and Republican office holders must sue the journalism cartel into oblivion. That cartel stems from the fact that the AP “wire” (and all other wire services) function as virtual meetings of all major journalists. And the fact that Adam Smith was exactly right when he wrote that " People of the same trade seldom meet together, even for merriment and diversion, but the conversation ends in a conspiracy against the public, or in some contrivance to raise prices.”

The conspiracy which has resulted is the propaganda that “journalists are objective.” That’s wrong because journalism is about bad news. The conceit that journalism is objective is the conceit that “negativity is objectivity” - and that is sheer cynicism. It is cynicism directed towards society, and that implies naiveté towards government. That is, socialism.
