A San Diego federal prosecutor was confirmed by the Senate Tuesday to a seat on the influential 9th U.S. Circuit Court of Appeals.
In a 53-40 vote, Patrick Bumatay became the 49th circuit appointee to be confirmed under the Trump administration, part of a steady drive by Republicans to remake the federal bench with conservative jurists.
It is an especially sweet victory for the administration given the 9th Circuits liberal lean, which has made it a prime spot for the presidents foes to challenge his policies. President Donald Trump has often complained about being treated unfairly by the nations largest appellate court, calling it a big thorn in our side and out of control.
The confirmation comes despite a lack of support from Bumatays two home state senators, Democratic Senators Dianne Feinstein and Kamala Harris.

Trump's 49th Circuit Court confirmation!
Now split it in half an appoint a half a dozen more judges. It’s gotten way too big of an area to work in anyway.
Trump has given priority to circuit court vacancies, and I think this might be the last circuit vacancy.
Now on to district courts.
Hey Kristina, just an FYI, anyone who isnt a conservative jurist is an activist judge.
There’s one more nominee for the 9th going to be confirmed tomorrow.
There is also one vacancy on the 5th and one on the 11th, both with nominees but the 5th nominee is likely to be withdrawn (not conservative enough).
Let’s pause and give credit where it’s due: Mitch McConnell. He’s been a WORKHORSE getting the President’s nominees through the process. This may be the single most thing McConnell is remembered for.
Sounds great! Now split the huge 9th circuit and appoint new judges. The 9th covers a third of USA - its been long recognized as bloated and unmanageably large

“VanDyke received a “not qualified” rating from the American Bar Association. ABA evaluators conducted 60 anonymous interviews with lawyers, judges, and others who had worked with VanDyke. The ABA published a scathing critique of VanDyke in a letter to the Senate Judiciary Committee; that letter asserted that interviewees described VanDyke as “’arrogant, lazy, an ideologue, and lacking in knowledge of the day-to-day practice’” of law. The ABA added that “’There was a theme that the nominee lacks humility, has an ‘entitlement’ temperament, does not have an open mind, and does not always have a commitment to being candid and truthful’”.[12] The ABA also raised “concerns about whether Mr. VanDyke would be fair to persons who are gay, lesbian, or otherwise part of the LGBTQ community, adding that “Mr. VanDyke would not say affirmatively that he would be fair to any litigant before him, notably members of the LGBTQ community.”[13]”

Agreed and very much under appreciated for it because of his other dumb things he does. President T has been great on courts which impacts 20+ years of our upcoming future. Mitch has done well on that. While democrats look at the next sound bite PDJT has thought about our future. Honestly I am surprised the Democrats have allowed it without a huge fight. Granted Mitch has again done well on the senate rules.

Getting close to flipping the 9th circuit - this is one of Trump’s top achievements.

Depends on what 'fair' means. I was picked as juror#1 despite trying not to be selected. Trial about an illegal alien who trespassed while trying to steal, injured himself and sued the property owner. Of course they didn't refer to him as an illegal, just as an undocumented immigrant. Final round of questions, judge asked me if I could be 'fair' to an undocumented immigrant, and I said "Sure, I can be fair as long as this illegal alien who trespassed wasn't doing anything illegal and against the law!". Court-room crowd laughing ensued. The illegal's lawyers asked for me to be dismissed as a juror. Which was fair for me because I needed to be at my job.
A few short of being 50/50 but getting closer.
