Federal Judge Blocks Pentagon Funds Targeted for Border Wall

Donald Trump's dream of building a "big, beautiful wall" along the southern border took a hit yesterday when a federal judge ruled that Pentagon funds totaling $3.6 billion diverted for 11 construction projects along the southern border could not be used for wall construction.

Significantly, the judge, David Briones of the U.S. District Court for the Western District of Texas, ruled that other funds, already approved by the Supreme Court, could be spent. Those funds, which come from a Pentagon counter-narcotics fund, could still be used for wall construction.

The argument being used by the city of El Paso was that Trump overstepped his authority in declaring a national emergency along the border. Briones agreed and issued a permanent injunction against the use of the funds.

Hi.

In the fwiw department, SCOTUS has already decided the President has the authority to declare a national emergency at the southern border. Or anywhere else.

This court is deciding which funds must be used, and which funds can’t. Judicial over reach...

Briones was nominated to the United States District Court for the Western District of Texas by President Bill Clinton on August 25, 1994, to a seat vacated by Lucius Bunton. The American Bar Association rated Briones Unanimously Qualified for the nomination. Hearings on Briones’ nomination were held before the Senate Judiciary Committee on October 6, 1994, and his nomination was reported by then-U.S. Sen. Joseph Biden (D-Del.) the same day. Briones was confirmed on a voice vote of the U.S. Senate on October 7, 1994, and he received his commission on October 11, 1994. Briones elected to take senior status beginning on February 26, 2009. He was succeeded in this position by Judge David Guaderrama.

"The Supreme Court already ruled on it." I would think this injunction would quickly get overturned or stayed by an appeals court, given the previous SCOTUS ruling.

I am skeptical that district courts have the authority to enter universal injunctions. These injunctions did not emerge until a century and a half after the founding. And they appear to be inconsistent with longstanding limits on equitable relief and the power of Article III courts. If their popularity continues, this Court must address their legality

Rick Moran’s piece is exceptionally gloomy. The Clinton Judge acknowledged in his ruling that other SCOTUS-approved funds could be spent. El Paso only has a bad reputation, if any, IMO, because bullets from gun battles across the border can hit buildings in El Paso, as happened to City Hall some years ago.

What SCOTUS should fight are the universal nationwide injunctions imposed by district judges. Those injunctions really should be imposed only on the judges’ particular districts.
