BREAKING: House Argues in Court Filing McGahn Testimony Needed as Impeachment Evidence

As we suspected, albeit against much criticism, House counsel Doug Letter has responded to the DC Appeals Court arguing the forced testimony of White House counsel Don McGahn is needed for evidence in impeachment trial. [Court pdf Avail Here]

This court filing today bolsters the unspoken background motive for delayed House Impeachment Managers. The House Judiciary Committee is using impeachment as support for their ongoing effort to gain: Don McGahn deposition, and Mueller grand jury material (6e). The goal is opposition research; impeachment is a tool to establish legal standing to obtain it. Everything else is chaff and countermeasures.

So they are admitting they did not have evidence when they published the articles. Does that fly in law?

I was under the impression that disputes involving Impeachment are NOT justiciable by the federal courts.

I thought the House and Senate create ALL their own rules.

In theory, if Trump refuses to waive Executive Privilege, the only recourse for the House is to charge Trump with Obstruction of Congress - which they already did.

It's not done until they send it to the Senate. Until then it's open ended. The senate needs to set a deadline for when these two articles can be submitted. Any new articles would have to take a new vote

Exactly. They voted to impeach without hearing all the evidence. We obviously know they deliberately prevented various testimony, evidence and lines of inquiry.

Now this is circular logic. They say they had to impeach him in order to get the evidence to impeach him. You have to vote for it to know what’s in it!

Since it's clear PDJT committed no impeachable crime, and the Dems' maneuvers amount to nothing more than an extra-Constitutional attempt to overthrow the presidency...

Especially in the light of the coordinated DOJ and Intelligence Community's spying on the Trump campaign (including wiretapping and humint)...

We're left to call this what it is: a coup.
All willing government participants should be indicted and tried at Guantánamo before a military tribunal.

they do. there are no rules of procedure in the Constition, and any rules can be changed and House rules don’t apply to the Senate and Senate rules don’t apply to the House... and there’s nothing in the Constitution that says the Senate can’t have a trial right now BECAUSE the House has passed articles of impeachment, the ONLY stipulation in the U.S. Constitution regarding what the House has to do to impeach ...
