Trump lawyers respond to articles of impeachment: 'Constitutionally invalid'

President Trump's legal team on Saturday issued a full-throttled defense to the articles of impeachment, refuting the substance and process of the charges while accusing House Democrats of engaging in a "dangerous attack" on the right of the American people to freely choose their president.

"This is a brazen and unlawful attempt to overturn the results of the 2016 election and interfere with the 2020 election now just months away," said a source close to the president's legal team, reading from the expected legal filing.

The legal paperwork is the first formal response to the two articles of impeachment read in the Senate on Thursday for abuse of power and obstruction of Congress.

Trump's lawyers argued that the articles of impeachment violated the Constitution and are "defective in their entirety" because they were the product of invalid House proceedings that "flagrantly denied the President any due process rights," a source close to Trump's legal team said Saturday in briefing reporters.

At the crux of Trump's defense is that he did nothing wrong in his July 25 phone call with the president of Ukraine when he asked for investigations into Democrats. Trump's lawyers argue that military aid to Ukraine was ultimately released without any announcement of investigations into former Vice President Joe Biden and his son, Hunter Biden.

High crimes didn’t mean literal crimes at the time.

I don’t like the precedent being set by the house, using impeachment as a weapon. But our recourse is at the ballot box, not howling at the moon lit hat this is unconstitutional.

Our constittutional rights are being incrementally eroded.

Government institutions like the House, Congress, bureaucracies, state governments, private corporations, slowly and steadilily peck away at the foundation.

there is little we can do but get in line and turn over our automatic rifles, take our stupid pee tests(just because) and let cops search our cars and send in our mail in only ballots and watch the masses stream across the border and get their "motor voter" ballots.

they will find a way to rationalize it "for our own good".and we WILL GET IN LINE, guilty until proven innocent

and Congressd will play along with this "impeachment game" because it is what they do, they have no intention to protect us , it's all about them and what THEY want

It is their turn for the limelight and camera, to pose, pontificate and virtue signal THEIR righteousness and how above the rats they are.

As much as San Fran Nan likes the cameras, most senators would give up a couple of inside trades for a chance to preen.

Forms the basis for the Senate to not even hear the charges— they are DOA, by definition, and by the very fact the dems in the constitutionally delineated House’s duty of impeachment, sought NO court review of their charges, because they knew they were not constitutionally sound. So, the Senate can decide that, politically, all on their own. Just saying, and that is the ones with the male hormones and ethics (few in number). Flimsy does not begin to describe the idiocy of this walking dead “impeachment”, and the a@@clowns bringing it.

One look at the “managers”-— a total joke, especially Schiff. And Val Demings, social worker motor cycle cop, and corrupt rep from Orange County, FL whose husband is County Mayor now— it’s a double hitter of corrupt Disney greed, mixed with black guilt factor built in. Fraud.

True. The House votes by simple majority whether or not to impeach, and the Senate votes by 2/3 majority whether or not to remove.

However, impeachment of a President inevitably raises disputes between the Executive Branch and the Legislative Branch regarding the use of Executive privilege, which can only be settled by the third coequal branch, the SCOTUS.

The Legislature has the authority to leave such questions unresolved, and proceed to a vote to impeach or remove without involving the courts, but it is ill-advised, as we have just seen.

House Democrats chose to bypass the courts and proceed to the vote for impeachment based on disputed allegations of “obstruction of congress” and “abuse of power”, both of which disputes could have been resolved by the courts, but were not. The predictable result: a purely partisan vote to impeach.

The House had the RIGHT to proceed to an impeachment vote on disputed charges without obtaining the SCOTUS’ ruling, as does the Senate have the RIGHT to proceed to a removal vote without getting a ruling from the courts.

But without such a ruling, when a dispute between the coequal branches is left unresolved, it is difficult, if not impossible, to garner more than a purely partisan vote - as we have seen in the House, and are likely to see in the Senate.

When no attempt is made to settle inter-branch disputes regarding matters as fundamental as the Constitutionality of Executive Privilege and Separation of Powers, an impeachment is completely devoid of merit, and without merit - all that is left is partisan politics.

If Senate Republicans don’t promptly throw these sham articles out, I don’t know what.
