Trump administration reveals 'birth tourism' crackdown: Pregnant women trying to travel to the U.S. to get American citizenship for their babies will be REFUSED visas

Trump administration will unveils crackdown on birth tourism and will bring it into force Friday

Move is against women who come to the U.S. to give birth to children so they get American citizenship

Visa applicants deemed by consular officers to be coming to the U.S. primarily to give birth will now be treated like other foreigners seeking medical treatment

The applicants will have to prove they are coming for medical treatment and they have the money to pay for it

Coming to the U.S. to give birth with the intention of gaining American citizenship for the baby is not in itself illegal

Trump has railed against birthright citizenship before but law on it appears to have been settled by Supreme Court in the late 1800s

Anyone born on U.S. soil is a citizen unless their parents are here on diplomatic passport

The Trump administration on Thursday published new visa rules aimed at restricting 'birth tourism,' in which women travel to the United States to give birth so their children can have U.S. citizenship.

Applicants will be denied tourist visas if they are determined by consular officers to be coming to the U.S. primarily to give birth, according to the rules in Federal Register.

It is a bigger hurdle to overcome, proving they are traveling to the U.S. because they have a medical need and not just because they want to give birth here.

Those with medical needs will be treated like other foreigners coming to the U.S. for medical treatment and must prove they have the money to pay for it - including transportation and living expenses.

No, they are not. The clause is:

The Citizenship Clause of the Fourteenth Amendment states that “[a]ll persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

Correct - Trump should issue an executive order to stop allowing citizenship to the child born here which will result in a court challenge and a final interpretation by the Supremes.

So they will just lie about their "primary" reason to visit the US. How are consular officers going to determine what is what?

Shut it down! There is no constitutional right to USA citizenship just for being born on American soil. Indeed the framers of the Constitution wrote it very carefully to make this clear.

“and subject to the jurisdiction thereof” is what exempts those with a diplomatic passport. Also invading armies. Not much of anyone else.

This is the WRONG freakin answer!

The CORRECT answer is that unless at least one parent is a U.S. Citizen, NOT permanent resident, student, tourist, or border jumper, the kid DOES NOT get automatic citizenship!

Should be retroactive but that’s not going to happen.
Make the %$#! correction TODAY!

Another question regards these “Medical necessity” visas.
How many of these cases are truly necessary and how many fail to leave?

Make them post a significant bond to ensure this is not used as a scam for illegal entry.
Cannot afford that?
Too bad, get care in your own country.
After all, we train thousands of foreign medical students at our universities every year.
Surely at least a few of them do return home to help their own nations citizens?

1: All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
