In the State of Washington, there actually statutory and case law that makes state and local governments liable for negligent supervision of criminals released from custody.

Those who wrote State of Washington were very distrustful of government. Washington has a statute that waives civil immunity. In Washington, private citizens have the legal authority to arrest anyone who they have positive knowledge have committed a felony. There is no exception for the Governor, AG, nor the members of the Washington State Supreme Court.

I know the statute and this was all confirmed to me by a leader of the Washington State Patrol, and a copy of the written WSP policy manual.
