Michael Moore, who runs truepundit.com says that his DOJ sources have said that Durham has yet to empanel a grand jury (as of two weeks ago).
If this is true, this would be astonishing.

Many in the know have said all along that the top FBI people will likely not see jail time because their jobs allowed them too much freedom and deniability. To convict someone of a crime they have to have broken a law, you have to have the ability to prove it in court, and a judge or jury has to convict them.
There are many other punishments that are highly effective however.

Trump may not be in a position to know details from a Grand Jury investigation, but I would be very surprised if he doesn't know whether or not there is a Grand Jury.
On a slightly different topic, what is happening with Ratcliffe? I thought that when Ratcliffe was first proposed, the lack of confirmation was an indication that Trump was in trouble. Now Ratcliffe evidently will be confirmed. Isn't that a sign that there is less trouble? What is going on here?

Was criminal code written in association with FISA courts? If not, with what precisely, would the abusers be charged? Don’t expect people to go to jail if there is no criminal code connected with their offenses. The DOJ is not going to invent it just to see people arrested. The more realistic result will probably be a reduction in sentences and/or full pardons for those abused by the court. I’d be the first person in the world to applaud Hillary going to the Federal pen, but again, to date not a single soul has pointed out the criminal code wherewith she would be charged. Perhaps Durham will cite it and use it to prosecute. We can hope.
