A new California law is supposed to help millions of freelancers by dictating that they be hired as employees.

“It makes sure that the 1 million independent contractors in California get the wages and benefits that they deserve,” says the law’s author, Assemblywoman Lorena Gonzalez.

But freelancers like musician Ari Herstand tell John Stossel, “You’re thinking you’re helping us, but you’re not … this could single handedly crash the California music economy.”

He points out that he’ll now have to put every musician he hires “on payroll, W2 him, get workers’ comp insurance, unemployment insurance … pay payroll taxes. I also have to now hire a payroll company.”

Musicians aren’t the only ones hurt.

The law targeted rideshare companies like Uber. Politicians claimed that the companies abuse drivers. But now many drivers object to the law, saying that they like being independent.

At first, the media were also big supporters of the law.

“Gig workers’ win,” wrote Vox.

But once the law passed, “Vox Media … cut hundreds of freelance jobs,” reported CNBC.

Assemblywoman Gonzalez was unapologetic. “These aren’t jobs," she sneered.

Herstand’s answer: “You're preventing us from doing what we want to do.”

I’m guessing they’d have to move their entire operation out of state. Which might be a good thing. Because when it comes to California, the next new law will always be goofier than the last one.

That's exactly what's happening in many areas. Unfortunately, not all freelancers can be replaced in this fashion. And I'm sure that the geniuses in Sacramento will be plugging this 'loophoole' real soon now.

Socialists excel at nothing greater than they do killing the goose that lays the golden eggs. This is just one more example.

Boy, how socialistic of them. We will tell you what a job is.

Also what they missed on the taxes side is it is all about the taxes. it was harder for the state to track and collect. Now they can throw the book at you.

To get that repealed will be like moving a mountain with a spoon.

They need a lesson in Civics. Our government is supposed to be empowered to do very little. The Constitution documents LIMITS on the government, being very specific about the few things the government is allowed to do.

If you're living in a country where the government prevents you from doing what you want to do, then you've lost the Republic and you've lost the Social Contract. It's an "anything goes" world, but so far We The People aren't acting like it -- only the politicians are acting like it.

Well, that's kind of what government DOES, isn't it?
The answer is to have the LEAST amount of government as is possible.

I hire freelancers online all the time.

I guess this means I have to steer clear of anyone living in the state of California.

In IT we have something called “bench testing”. You imagine a scenario and play it forward under the new rules/paths and see what happens. Stuff like this: You are a bar owner and you want to bring in a band, what do you do today? What will you do after the law passes? Will that help or hurt the band?

It would only take a few bench testing scenarios to figure out the law would really hurt that economy.

But they don’t do that.

You realize that the law has already been passed and implemented in California, right?

It’s destroying a lot of jobs and will badly impact a lot of industries.

Yes. I’m saying what should have been done before they passed it. I’ve been talking about it in threads on a musician site. It’s killin’ the guys in California. I mean it is an industry changer.

No. You cannot hire out of state. And if you live in CA and you freelance out of state, that out of state business must comply with the law and hire you as an employee. This has hit freelance writers particularly hard as out of state publications won’t touch anything from a CA writer.

By the way, I believe Sanders and Biden support this as a national law.

I've done a few gigs as an 'independent contractor'. NOT in California. Usually for slightly longer term things like musicals or summer shows. Saves the employer a lot of money on all the BS this article talks about.

So, they can hire better quality people.

There was a CA law passed around the .com boom to try and force Microsoft to hire contractors.
The end result is now MS and Intel only hire contractors for 12 months and then fire them.

Qualcomm gets around the issue by hiring you for 11 months and you are gone for 2 months and re-hired.

The end result is Microsoft and Intel hired more H1b and tried to fire direct employees.

Workers who are contractors LIKE being contractors as there is minimal office politics.
I LOVE contracting!

That's not the point if you're a politician. The point is to make you look like a champion of the "little guy." What actually happens to said little guy is really none of their concern.

Dumb question ... If I’m a freelance writer in CA, what stops me from using a Nevada P.O. Box as my address, or even using a family member’s address in another state?

Intel gets around the issue by hiring from companies that specialize in temporary work. As part of the hire contract you have to agree not to even say you work at Intel!
