No, it sounds like they already have a design that they can sell to the highest bidder, despite the grant given by HHS.
If they are already selling units at $12,000 to $13,500., they already have a workable design and product.

The above statement indicates that HHS needs to have a "risk assessment officer" who understands corporate law.
It sounds to me that HHS got contractually "hornswaggled", bamboozled, and deceived by a manufacturer in Pennsylvania.
All perfectly legal... ugh !
